DMCA Policy

1. Introduction and Purpose

melabel (operated by Mushroom Entertainment Inc.) respects the intellectual property rights of others. This DMCA Policy outlines procedures for reporting alleged copyright infringement and for users to challenge content removal.

This policy applies to all content on melabel, including user uploads, the melabel Store, and content distributed through melabel to DSPs.

3. Filing a DMCA Takedown Notice

Per 17 U.S.C. § 512(c)(3), include:

  1. Your signature (physical or electronic)
  2. Identification of copyrighted work
  3. Location of infringing material on melabel (URLs, project/file names)
  4. Your contact information (name, address, phone, email)
  5. Good faith belief statement
  6. Perjury statement that information is accurate
  7. Authorization proof (if not the copyright owner)

4. How to Submit

Allow up to 10 business days for acknowledgment.

5. Processing of Notices

Upon valid notice, melabel will:

  1. Disable access within 24-48 hours
  2. Notify the affected user
  3. Preserve records as required by law
  4. Notify DSPs if material was distributed
  5. Investigate and may request additional information

6. Counter-Notification Process

Per 17 U.S.C. § 512(g), counter-notifications must include:

  1. Your signature
  2. Identification of removed material and prior location
  3. Perjury statement (mistake/misidentification)
  4. Your contact information
  5. Consent to Federal District Court jurisdiction
  6. Acceptance of service of process

7. Restoration of Content

After valid counter-notification: 10-14 business day waiting period. If no legal action notice received, content is restored. You must repost restored content.

8. Repeat Infringer Policy

  • First Violation: Content removed + warning
  • Second Violation: Content removed + formal notice
  • Third Violation: Account may be terminated

Three or more valid notices within 12 months may result in suspension/termination. Immediate termination possible for willful infringement.

9. Misrepresentation Warning

Per 17 U.S.C. § 512(f): knowingly false claims may result in liability for actual damages, profits, attorney's fees, and statutory damages up to $150,000.

melabel will pursue legal action against false DMCA notices.
